Terms & Conditions
These Terms & Conditions govern the purchase and use of services, memberships and digital resources provided by Portugal Wizard.
By purchasing a service or membership, the client confirms that they have read, understood and accepted these Terms & Conditions.
1. Application of these Terms
These Terms & Conditions apply to all services, memberships, consultations, digital resources and other paid products provided by Portugal Wizard, unless different written terms are expressly agreed for a specific service.
The scope of each service is limited to the service purchased and to any inclusions expressly stated in the relevant proposal, service description or purchase page.
2. Nature of Services
Portugal Wizard provides practical administrative assistance, guidance, coordination and support in connection with relocation to and residence in Portugal.
Depending on the service purchased, this may include assistance relating to visa preparation, Portuguese tax identification numbers, banking, accommodation, company formation, administrative procedures, document organisation and settlement matters.
Portugal Wizard is not a law firm, government authority, immigration authority, tax authority, bank, consulate or visa-processing authority.
Where legal, tax, accounting, notarial, translation or other regulated professional services are required, Portugal Wizard may coordinate with appropriate independent professionals.
3. Client Responsibilities
The client is responsible for providing complete, accurate and truthful information and documentation within the time reasonably required for the service.
The client must review documents and information prepared or organised on their behalf and notify Portugal Wizard promptly of any error, omission or change in circumstances.
The client remains responsible for meeting official deadlines, attending appointments, signing documents where required and complying with instructions issued by public authorities or other competent entities.
Portugal Wizard is not responsible for delays or adverse consequences caused by incomplete, inaccurate or late information provided by the client.
Unless otherwise stated, purchased services must be used within 12 months of purchase. Failure to provide the documents or cooperation required to complete the service during that period does not create a right to a refund.
4. Visa and Immigration Services
Portugal Wizard assists clients in preparing and organising visa and immigration applications based on the documents and information made available by the client.
Portugal Wizard does not decide visa or residency applications and cannot guarantee approval, processing time, appointment availability or the interpretation adopted by a consulate, visa centre, immigration authority or other public body.
Requirements, procedures, appointment systems and documentary practices may change without notice.
The final decision on any visa, residency visa, residency permit or residency card application belongs exclusively to the competent authority.
5. NIF and Fiscal Representation
Where Portugal Wizard obtains or manages a Portuguese tax identification number (NIF) for a non-resident client and fiscal representation is included, no annual fiscal representation fee is charged while the client remains a non-resident and Portugal Wizard continues to act as fiscal representative under the original service.
Once the client becomes resident in Portugal and receives the documentation that allows the fiscal address to be updated with the Portuguese Tax Authority, including the Portuguese residency card where applicable, the fiscal address must be updated and the fiscal representation terminated.
The client must provide Portugal Wizard with the documents required to complete that update within 30 days of receiving them.
If the necessary documents are not provided within that period and Portugal Wizard remains registered as fiscal representative, the representation continues and a €100 renewal fee will apply.
Portugal Wizard is not responsible for penalties, notices, taxes or other consequences arising from the client’s failure to provide documents, update information or pay amounts due to the Portuguese Tax Authority.
6. Bank Account Services
Where Portugal Wizard provides assistance with opening a Portuguese bank account, Portugal Wizard prepares and coordinates the client’s application based on the documents provided.
The final decision to open, refuse, restrict or close an account belongs exclusively to the bank.
Banks may request additional documents, information, identification procedures or compliance checks at their discretion.
Portugal Wizard cannot guarantee that an account will be approved or opened within a particular period.
Any bank charges, deposits, card costs, courier costs or other third-party charges are separate from Portugal Wizard’s service fee unless expressly stated otherwise.
7. Company Formation and Independent Activity
Portugal Wizard may assist with the administrative preparation and coordination of company formation or independent professional activity in Portugal.
Where services from accountants, lawyers, solicitors, notaries, commercial registries or other regulated professionals or authorities are required, those services may be performed by independent third parties.
Portugal Wizard does not provide legal or tax advice unless such advice is expressly provided by an appropriately qualified professional.
The client is responsible for deciding whether a particular company structure, activity or investment is suitable for their circumstances.
8. Property and Accommodation Services
Portugal Wizard searches for suitable properties, liaises with landlords and real estate agents, visits the property and reports on its observed condition. Portugal Wizard acts independently and remains neutral in relation to the transaction. We are not a party to the tenancy or purchase agreement and cannot be held responsible for the outcome of the transaction or for the acts or omissions of the landlord, agent or any other third party. The property search service shall be deemed fully completed upon the signing of the relevant tenancy or purchase agreement.
Any rent, deposit, reservation fee, agency fee, purchase price, utility cost or other third-party amount is paid directly by the client unless expressly agreed otherwise.
9. Documents, Templates and Checklists
Documents, templates, checklists, guidance materials, roadmaps, examples and other resources supplied by Portugal Wizard are prepared for the client’s own use in connection with the service purchased.
This document was prepared exclusively for your personal use and must not be shared or forwarded to third parties.
The same principle applies to Portugal Wizard templates, checklists, membership resources, guides, screenshots, instructions and other proprietary materials.
They may not be copied, published, distributed, sold, sublicensed, uploaded to other platforms or made available to third parties without prior written permission from Portugal Wizard.
Client-specific documents may be shared with the authorities, banks, professionals or other entities for which they were prepared.
10. Membership and Digital Services
Portugal Wizard memberships provide access to digital guidance, tools, roadmaps, checklists, templates and other membership resources according to the plan purchased.
Access is provided immediately after purchase.
Membership content is intended for the registered member and, where expressly included, members of that person’s household or application.
Login credentials and membership access may not be shared with third parties.
Portugal Wizard may update, replace or reorganise membership content to reflect changes in procedures, legislation, official guidance or the structure of the platform.
Membership content is guidance and does not constitute a guarantee of visa approval, residency approval or any other governmental outcome.
11. Third-Party Services and External Costs
Portugal Wizard may coordinate with banks, lawyers, solicitors, accountants, translators, notaries, couriers, real estate agents, government bodies and other third parties where necessary for a service.
Unless expressly included in the price, third-party fees and official charges are payable separately by the client.
Portugal Wizard is not responsible for the acts, omissions, delays, system failures or decisions of independent third parties or public authorities.
12. Prices and Payments
Prices are those displayed or quoted at the time of purchase.
A service is considered booked once the applicable payment has been received, unless expressly stated otherwise.
Payment authorises Portugal Wizard to reserve capacity and begin the administrative preparation, review, coordination or other work associated with the purchased service.
Any external costs not expressly included in the service price remain the responsibility of the client.
13. Cancellations, Refunds and Withdrawal Rights
All Portugal Wizard services and memberships are non-refundable once the service has commenced or access to the membership or digital materials has been provided, except where a refund is required by mandatory applicable law.
For memberships and digital services, access to the content is made available immediately after purchase. By requesting immediate access, the client expressly asks Portugal Wizard to begin supplying the digital service without waiting for the expiry of any statutory withdrawal period that may otherwise apply.
For other Portugal Wizard services, performance begins immediately after payment. Portugal Wizard starts reserving capacity, allocating time and resources, reviewing information, preparing the matter and/or coordinating the work required for the purchased service.
The client therefore expressly requests that performance begins immediately following payment rather than waiting for the expiry of any statutory withdrawal period that may otherwise apply.
A change of mind, change of plans, decision not to relocate, decision not to proceed with an application, failure to provide documents, client inactivity, change in personal circumstances, refusal by an authority, lack of appointment availability or delays caused by a third party do not create a right to a refund.
Where mandatory consumer law grants a right that cannot legally be excluded or waived, that mandatory right will continue to apply.
Any exceptional refund expressly agreed by Portugal Wizard must be confirmed in writing.
14. Communications and Calls
Routine questions, document exchanges and updates should be handled by email so that the client file contains a complete written record.
Unless a different service expressly provides otherwise, Portugal Wizard services include up to three checkpoint calls during the service.
These calls are intended for significant stages of the process and are not an unlimited-call service.
Additional calls or consultations may be subject to an additional fee.
WhatsApp or other instant messaging channels do not replace the normal written communication process unless Portugal Wizard expressly agrees otherwise.
15. Intellectual Property
All Portugal Wizard website content, membership content, templates, checklists, guides, written materials, graphics, systems, processes and branded resources remain the intellectual property of Portugal Wizard or their respective rights holders.
Purchase of a service or membership grants the client a limited, personal, non-transferable right to use the relevant materials for their own relocation or administrative process.
It does not transfer ownership of the materials or grant any right to reproduce, resell, distribute or commercially exploit them.
16. Personal Data and Private Documents
Portugal Wizard processes personal information and documents as necessary to provide the purchased services and in accordance with the applicable Privacy Policy.
Where documents need to be shared with banks, authorities, professional partners or other third parties in order to perform the service, only information reasonably necessary for that purpose will be shared.
Clients should not send passwords or other credentials unless Portugal Wizard has specifically requested them through an appropriate process.
17. Legal and Administrative Changes
Immigration, tax, banking and administrative procedures may change.
Portugal Wizard uses reasonable efforts to keep guidance and services aligned with current procedures but cannot guarantee that a public authority or third party will not introduce a new requirement, interpretation, fee, form, platform or process after a service has been purchased or guidance has been issued.
Where a change materially affects an ongoing service, Portugal Wizard will adapt the process where reasonably possible.
18. Suspension and Termination of Services
Portugal Wizard may suspend or terminate a service where the client:
- repeatedly fails to provide required information or documents;
- provides false, misleading or materially incomplete information;
- fails to pay an amount due;
- behaves abusively or threateningly toward Portugal Wizard, its team or professional partners;
- requests Portugal Wizard to participate in unlawful, misleading or improper conduct.
Suspension or termination for these reasons does not automatically create a right to a refund.
19. Limitation of Liability
Portugal Wizard is responsible for performing the purchased service with reasonable care within the agreed scope.
Portugal Wizard cannot be held responsible for decisions of public authorities, banks, consulates, visa centres, landlords, agents, professional advisers or other independent third parties.
Portugal Wizard is also not responsible for losses resulting from inaccurate or incomplete information supplied by the client, failure by the client to follow instructions, missed deadlines outside Portugal Wizard’s control, changes in law or procedure, system outages or events beyond reasonable control.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by mandatory applicable law.
20. Complaints and Disputes
If a client is dissatisfied with a Portugal Wizard service, the client should first contact Portugal Wizard in writing with a clear description of the issue so that it can be reviewed and, where appropriate, resolved.
Both parties should make a reasonable effort to resolve the matter directly before commencing formal proceedings.
Any mandatory consumer dispute-resolution rights available under applicable law remain unaffected.
21. Governing Law
These Terms & Conditions are governed by Portuguese law.
Any mandatory consumer protections or jurisdiction rules that apply by law remain unaffected.
22. Changes to these Terms
Portugal Wizard may update these Terms & Conditions from time to time to reflect changes in services, business practices or legal requirements.
The version applicable to a purchase is the version in force at the time of that purchase, unless a later change is required by law or expressly accepted by the client.
